| Terms & ConditionsThese terms of sale apply to all goods and services supplied by Bar Activity. By using the Bar Activity website you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, you should not use the Bar Activity website. PRICE & AVAILABILITYPrices on the Bar Activity website are quoted in British Pounds (£) and are subject to VAT at the standard rate. Bar Activity reserves the right to adjust prices if the standard VAT rate should increase. Prices may be subject to change and if the price goes up or down in between you placing and receiving your order, we will honour the original price. All products and services provided by Bar Activity are subject to availability and may be withdrawn at any time, including after you have placed your order. If your order cannot be fulfilled we will let you know. We always try to make sure that the prices listed on the Bar Activity website are correct but errors may occur. If we discover an error in pricing of the products in your order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming the order at the correct price or cancelling it. If the order is cancelled we will refund you in full. You will be notified of delivery charges automatically before you submit your order. PAYMENT INFORMATIONOrders may be processed online or by telephone using Visa, MasterCard, Delta, Switch/Maestro and Solo. We aim to debit money from your account within one working day after receiving your order. Payment must be made at the time of your order unless otherwise agreed in writing, regardless of when the goods are to be delivered. For online orders, payment can be made by credit or debit card only. Bar Activity reserves the right to refuse any order from the Purchaser at its discretion. Bar Activity reserves the right to charge an administration fee, details of which are available upon request, and which may be varied from time to time, for processing a payment, and such fee will be charged to the Purchaser together with any collection costs/court costs/legal fees incurred in obtaining payment. DATA PROTECTIONAny information supplied by you will only be held and used for our purposes in order to conduct business with you and to improve our level of service. We will not pass on your details to any third party without your express agreement. When you order, we need to know your name, email address, delivery address, credit or debit card number and expiry date. This enables us to process and fulfil your orders and to notify you in the event of any queries. We also request your telephone number which allows us to contact you urgently if there is a problem with your order such as a courier having difficulty in achieving a delivery. We will only send you emails or other information where you have given us your consent. We shall comply with all applicable UK data protection legislation from time to time in place in respect of any personal information relating to you gathered by us. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct them promptly. Should you wish to be removed from our mailing lists all you need to do is contact us and all further contact with you will cease. DESCRIPTIONS & SUBSTITUTIONSWhilst we make every effort to show and describe our products as accurately as possible, in rare cases the final product may differ slightly. This often happens with plain colour products from different manufacturers for example various items from within a theme party pack may have slight variations in shade where they have come from different manufacturers. We occasionally substitute products of a similar description, where for example the original item becomes unavailable. In the event that you are not happy with the substitute we send, you may return this to us immediately for a full refund. Bar Activity has tried to make the descriptions and pictures of the products as accurate as possible but you should check the dimensions stated on baractivity.com or contact us for exact dimensions. RETURNS AND CANCELLATIONSGoods returned for refund or credit must be received by Bar Activity in perfect saleable condition and in their original, undamaged packaging and in the original quantity as specified in/on the catalogue/website, within 30 days of receipt. We will consider the overall condition of the goods being returned when making a refund and reserve the right to withhold a percentage of the refund value of returned goods if they are not in suitable condition for resale at their original catalogue price. The Company will not be liable for any carriage or costs incurred in returning goods unless they are defective or have been sent in error. Any damages or breakages must be reported within 3 days of receiving your order. We cannot be held responsible for returned items lost in the post. You are responsible for returning goods to us and we recommend sending the package by recorded or special delivery, this is because proof of posting is not proof of receipt. All goods returned whether the item is faulty, defective or unwanted, please send back to Bar Activity, Heronsgate, Saltmoor, Burrowbridge, Somerset. TA7 0RW. We will refund or replace within 10 working days of receiving the returned good. No liability is accepted by Bar Activity for any costs or charges incurred by the Purchaser which may arise due to a delay in processing a refund. If you return an item because of an error on our part, or if it is defective, we will refund you for the return postage. Please note any goods returned, not due to being our fault will not have their postage refunded. Please note that we cannot accept return of personalised products or DVD's unless they are defective. DELIVERYWhere possible, goods will be dispatched on the day we receive your order. Our aim is to deliver all goods to UK mainland within 2 to 3 working days and all other addresses within 7 working days of confirming the order (unless otherwise stated). However we will notify you if items are likely to take longer than 10 working days to reach you. Garden benches for example, may take anything up to 14 days to deliver. All delivery costs will be shown automatically before you confirm your order. For most UK mainland addresses, delivery is free of charge for orders of £150 (excluding delivery and VAT) or more that are placed online for all UK mainland addresses except those list below. There is an additional delivery surcharge (charged by our courier company) for orders delivered to addresses in the following areas...
Unfortunately, we can not offer free delivery to these addresses within these areas. Our orders are sent by courier on a 24-hour service or by Royal mail (first class). Our couriers require a signature and operate between 9am and 5pm on weekdays only, so please specify an address where someone will be able to sign for the delivery. If your delivery has not arrived within the time frame that we state please contact us by either phone or email and we will do our best to make sure you receive your order, as quickly as possible. We do everything we can to make sure your goods are delivered on time but Bar Activity can not be held liable for any late deliveries, as we are relying on a 3rd party company. Unless otherwise required, Bar Activity may hold any order(s) where an item is out of stock until all items on that order(s) are available. Bar Activity reserves the right, where payment for goods ordered has been made by cheque, to hold any such order until the Company has received confirmation that the cheque has been cleared and the funds paid to the Company, and at its discretion despatch the order only after such confirmation, which can take up to 10 working days (excluding weekends), has been received. Delivery outside the EU may be subject to local import taxes, which is your responsibility where they apply. If they do apply our shipping company should contact you once your goods are in customs to let you know the charge. Unfortunately we can not be held responsible for any charges. Any items that are sent out for delivery and where the courier company attempt to deliver the goods but are unable to gain access may be returned to us. In these circumstances any postage costs sustained by Bar Activity will be deducted from any refund due to the customer. RISK & OWNERSHIPOwnership and title of any goods supplied remains with Bar Activity until such time as the company has received payment in cleared funds from the Purchaser of all sums of money outstanding. Risk of damage to, or loss of the goods, passes to you at the time of delivery to you (or the agreed delivery address), or, if you fail to take delivery at the agreed time, when we tried to deliver. You will own the goods once they have been successfully delivered and when we have received cleared payment in full. LIABILITYWe will not be liable for any loss caused to you by late delivery of goods, or consequential and/or subsequent loss once you have accepted delivery. We will not be liable for any loss or damage to goods once they have been delivered in accordance with your delivery instructions. This site should only be used for information purposes. We shall not be liable for any damage or loss that may occur in the use of any of the information contained or advice given in this site excepted as stated in the terms and conditions of sale (where applicable) and to the extent that such liability cannot be excluded by law. We are not responsible for the sites accuracy, although every effort has, is and will be made to ensure that the information contained is correct and up to date, nor for its fitness for a particular purpose or the reliability of access to this site. We will not be liable for damages or losses resulting from your use of or inability to use this site. Neither do we guarantee that this site will operate free of error or that it is free from computer viruses or any other contaminating computer programme. We will not be liable to you or in breach of contract for delay or failure to perform due to any causes beyond the reasonable control of us or our suppliers, including but not limited to Acts of God, civil commotion, industrial dispute, riots, flood and legislation. No liability is accepted for any loss or damage, however caused, resulting from the use of our products, whether for injury, profit or date loss. Every reasonable care is taken to ensure that products are suitable for the use intended and described accordingly. CHANGES TO THE TERMSWe reserve the right to remove, modify or change without notice any information on this site from time to time.
